Dear John,

I'm formally appealing this 23 January 2012 decision of the Commonwealth Director of Public Prosecutions with you, re my freedom of information request to them, as this DPP letter clearly states they are in receipt of the information I'm seeking, sent to them from the Australian Federal Police. The Commonwealth DPP is point blank refusing to process my request, because he claims (in effect), it's not his concern, which is absurd.

If the Commonwealth DPP wants to formally claim they do not have the information I'm asking for, then a letter similar to the one I recently received from Australian Customs is required. Further still, I have already put a Freedom of Information request to the AFP re this matter (at the same time), and I'm still awaiting their response. However, it's very much in the public interest to ascertain whether or not the Commonwealth Director of Public Prosecutions was also in receipt of core evidence, before he decided to award a violent career criminal over three quarters of a million dollars. I don't think that's unreasonable, given his unprecedented witch hunt against Schapelle.

May I also draw your attention to this fax just sent to Julia Gillard PM, and this half page news ad based on those questions - plus the graphic new documentary that has just been released.

Schapelle Corby - A Letter To Geoff Lyons MP Federal Member for Bass

Dear Geoff,

Can you please help me, and make sure Julia answers the questions above?

You see, the QANTAS baggage handlers who helped to import 200 kilos of cocaine into Australia in 2004 (using unwitting passengers as innocent drug mules), were never arrested or charged, despite the huge corrupt payments they received. This is stark contrast to way similar offenders are treated in the UK, where they get many years in jail.

Further, no-one will tell me how and why QANTAS employed long-term criminals like "Tom," Easton Barrington James and Norman Niass as baggage handlers - even though the employment of crooks at a major airport was identified as one of the key factor in the Lockerbie aviation disaster.

And I think every tax payer in the land will resent the $1.6 million of public money that was given to a violent offender like "Tom," not to mention the $43,000 (plus), the government lavished on his trip to Switzerland.

Further still, the frightening disappearance of many police guns (and other equipment), from Sydney Airport, as reported by Australian Protective Services Officer Gary Lee Rogers, was never, ever investigated. So what the hell is going on?

Lastly, it's a matter of public record (at the highest levels), that Schapelle's boogie board bag was illegally diverted (by persons unknown), from the mandated screening processes, after she checked it in as normal. And again, referring back to the Lockerbie disaster, lack of screening was identified as one more key factor.

I look forward to hearing from you Geoff, these are very serious issues.

Re: A formal request for re-investigations, and new investigations - and the embedded links within this correspondence are also part of the evidence I'm submitting.

May I draw your attention to The Whitewash Report, Section 2.2.1.4. "The Strict Limit of Investigations," and also summarise what we have ascertained to date:

1. The Australian Federal Police did NO investigation of Brisbane Domestic Terminal until around six months after Schapelle's arrest, and about four months after they'd received a letter from DFAT which specifically asked for those inquiries to be done.

2. That at no time did they do any investigation into Sydney Domestic or International Terminals, despite a specific request from DFAT for them to do so (post a meeting between Alexander Downer and Schapelle's legal team on 22 Nov 2004).

3. Their much belated "Investigation" of Brisbane Domestic Terminal was without the help of the most basic police tools, e.g. forensic examination of the physical evidence for fingerprints, human DNA, plant source and source of the space bags in which the drugs were wrapped (despite more than adequate legal means to request this information), and without the help of relevant CCTV footage - so what the hell are their documented professional standards, re immediate forensic preservation of CCTV from a crime scene?

4. The bizarre anomalies in Schapelle's case should have alerted them to take the utmost care in this strange incident immediately.

So can you please ascertain whether or not the Australian Federal Police . . .

1. Formally identified and investigated the relatively small number of airport staff, as per this diagram (from this report), who handled Schapelle's bag (e.g. every member of that group).

2. Formally identified and investigated every Sydney Airport baggage handler who may have had contact with Gary McDonald's bag - because it was handled by very much the same crew (extract from page 3 -17), at very much the same time.

3. Formally identified and investigated every Sydney Airport baggage handler who received a cut of this corrupt $300,000 payment.

Plus:

a) What were the outcomes?

b) If those investigations did not occur, WHY?

Further still, can you please contact and interview journalist Philip Cornford, re his police quote of 5 March 2005, about the known use of innocent drug mules - and . . .

Document his police source/s.

Interview that/those police source/s.

Further investigate and report on the outcomes of those crime investigations.

And even more seriously, can you please investigate whether or not the appalling failure of the Australian Federal Police to investigate Sydney Airport (as documented above), was related to chronic insider corruption at that facility . . .

1. Please ascertain whether or not the frightening inventory losses reported by Australian Protective Services Officer Gary Lee Rogers were ever investigated, because it seems the AFP have no record of these inquiries, and the Commonwealth Attorney General's Department has only just woken up to my further FOI request to them (see paragraph 7). And if they were not formally investigated, can you please find out what the hell was going on?

2. Can you please find out if all of the allegedly corrupt police named by Tom were ever investigated, and if not, why not?

3. Can you please re-interview Tom on this matter, and if he now denies the accusations he made under oath, can you please refer him back to the police and courts, re further investigation for perjury. And re that last link, see Section 9 - points 2 a (i) and 2 b, governing Tom's witness protection. And note, some openly say his inclusion was surrounded by impropriety.

Can I please have the transcripts of your interviews with Chris Lush and Mick Milakovic, re their serious claims of possible insider criminal activity at Brisbane Domestic Airport (made to Channel 9 in 2005), roughly around the time you were conducting the very belated Operation Isogon.

I assume you take piles of cut and damaged baggage locks, some secreted in a ceiling cavity, very seriously?

Re: A formal request for an investigation into the propriety and ethics of Operation Isogon (and all the embedded links in this blog post are also part of the evidence I'm submitting, and extremely important).

I rang ACLEI on Friday afternoon (20th January 2012), to confirm whether or not your organisation had received this new complaint from me, and your operative said he had. I also took the opportunity to ask him if he'd heard of the Lockerbie Disaster (he has). He also agreed with me that if corrupt baggage handlers could secrete 10 kilos of cocaine in a passengers luggage (as they did at the exact time Schapelle flew) - or 4.2 kilos of marijuana for that matter - they could hide a similar amount of Semtex. So do I need to further underline the utter seriousness and gravity of your responsibilities in this matter?

Therefore re that new complaint, this current one and any further concerns of mine, I will submit formal Freedom of Information requests a reasonable time (a period of weeks), after my correspondence - because I do not think allowing you one whole year (as per my previous complaint to your department), to simply do an "Assessment" that merely involves flicking correspondence between yourselves and the people you're supposed to be "Investigating" is acceptable - in fact, it's laughable (if it wasn't so tragic). You gave zero documentation of any form of independent verification or investigation (merely asking the AFP for their version of events) - plus the cosiness between yourselves and the organisation you're charged with policing is both appalling and frightening. May I remind you even extreme seniority is no bar to the most grave corruption?

So now may I draw your attention to The Whitewash Report, and Section 2.2.1.2. Here's a quote:

Citing 'no admissions had been made’, as supporting evidence to dismiss serious allegations, is clearly extremely questionable in itself. However, in July 2011, The Hidden World Research Group identified and directly interviewed a Brisbane baggage handler, who categorically denied that all the baggage handlers had been interviewed.

It's a section that, though it doesn't name it there, is a direct reference to Operation Isogon and a supposed police "Investigation" of Brisbane-based baggage handlers - and how the hell you could have accepted that not even quarter-baked piece of trashy cover-up (without a single question), is beyond me, and probably beyond anyone else with a shred of common sense. Maybe your officers have never heard of "Occam's Razor" and it's blindingly obvious application in this case? So let's start from the top . . .

1. Where are the interviews with the check-in staff? Why didn't they "Notice" 4.2 kilos of bulging, slashed, stinking marijuana in a grossly overweight boogie board bag - and why didn't this scenario spark the required manual check? And is it likely that anyone intent on smuggling 4.2 kilos of marijuana would deliberately do so via an overweight boogie board bag that (according to airline regulations), would be subject to a physical search? Why was there no police mention of this thoroughly obvious point?

2. Why didn't anyone else who handled the bag "Notice" the bulge and the stench either?

3. Why didn't the extremely bizarre nature of Schapelle's alleged crime, as confirmed by Australian Customs, contemporary press reports, economic data and insider comments, plus her complete lack of criminal background or profile, spark the need to treat Brisbane Airport as a potential crime scene immediately? Why the hell was this "Investigation" delayed for almost 6 months after her arrest on the 8th of October 2004 - plus delayed for almost 4 months after a letter from DFAT to Michael Phelan which directly requested it? Gross insider criminality was a well known problem, as also confirmed by Senior Customs Officer Allan Kessing, and as confirmed by the massive inventory losses reported by Australian Protective Services Officer Gary Lee Rogers. Then (of course), there are the numerous documented instances of insider theft and tampering. Didn't anyone teach the Australian Federal Police the extreme urgency of the first 48 hours, re any crime scene? Or were they just on a tea break for the first six months?

4. Were Chris Lush and Mick Milakovic ever interviewed, re their comments to Channel 9 about Brisbane Domestic Terminal? Were all the trashed and destroyed luggage padlocks ever investigated? Can you please find out, because Geoff Askew (Head of Security at Qantas at the time), didn't have a clue . . .

“ROSS COULTHART: And then there's Chris Lush who was hired to install cabling in the ceiling at Brisbane Domestic Airport terminal, just a few weeks after Schapelle Corby left for Bali.

CHRIS LUSH: And we just noticed about thirty odd locks sitting beside the conveyor belt that some had parts of bags on them It looked like someone had been rummaging through bags and taking locks off in a certain area and taking bags off and obviously putting them back on and scavenging through bags I'd say

ROSS COULTHART: In Sydney we tracked down another witness with a remarkably similar story. In 2003 Mick Milakovic was working on air-conditioning in the ceiling of the international terminal right next to the luggage conveyor belts.

MICK MILAKOVIC: We'd been working in the ceiling space and found probably half a bucket of pad locks.

ROSS COULTHART: Half a bucket?

MICK MILAKOVIC: Approximately. I'd been counting up to twenty.

ROSS COULTHART: Do you think that there's a plausible explanation, an innocent explanation for why all those locks were there. Perhaps they'd fallen off as they hit something on the conveyor belt?

MICK MILAKOVIC: No, there is no way. Because they had been cut. They'd been cut. If it was locked and were there I can say it is accidentally. But locks are in two pieces.

ROSS COULTHART: Do you think it's plausible that large numbers of locks could be broken snapped by the way in which they're pushed through the baggage handling system.

GEOFF ASKEW, QANTAS SECURITY BOSS: Ross I am unable to answer that. I know where you're going with this but I can't answer that.”

5. What formal procedures are the Australian Federal Police supposed to follow re the immediate preservation of forensic CCTV evidence, and why weren't these procedures followed within the first 48 hours, given all the above facts? There were a huge number of cameras relating to Schapelle (and her bag), as described by Australian Customs, all the way from the car park to the point where her luggage was loaded on to the plane. "Operation Isogon" mentions "Evidence," while blithely neglecting to mention the most pertinent CCTV evidence was inexplicably destroyed, even though (given this was a formal crime scene), it should have been preserved as per AFP guidelines straight away. Maybe it ended up in the roof space, rotting and forgotten, along with all the cut baggage locks?

6. Obviously, forensics were also crucial to this Australian criminal investigation, e.g. "Operation Isogon," so why an earth didn't the AFP utilise the Mutual Assistance in Criminal Matters Act, to facilitate their knowledge base? How could they even begin to "Investigate" the Brisbane-based airport staff without this vital knowledge? Hopefully, we can find out. Weren't they interested in discovering who's fingerprints (and maybe DNA), were on/in the inner bags? Weren't they interested in where the drugs were grown? Weren't they interested in who manufactured the space bags, and where they were sold? Given they were specifically asked by DFAT to investigate these exact points as early as November 2004?

7. Why didn't "Operation Isogon" mention or investigate the frightening staff failure to add Schapelle's boogie board bag to the airport's computerised luggage handling system?

7. Can you please directly investigate whether or not every relevant staff member at Brisbane Domestic terminal (who may have had direct contact with Schapelle's bag, rosters would be a good starting point), was . . .

a) Interviewed.

b) Drug screened.

c) Fingerprinted.

d) Checked re their previous criminal history.

e) Had their vehicles and home premises forensically checked for drug residues and equipment (given this may well be an ongoing offence, even to-day). Because according to journalist Tony Wilson, this capability existed at the time.

f) Investigated re their relevant phone records, banking records and visible assets. Though maybe the Commonwealth DPP needs a bit of in-service education on this last point, because he seems to think it's not unusual for QANTAS baggage handlers to have the odd three-quarters of a million dollars hanging around.

8. Obviously, a vital part of "Operation Isogon" was the exclusion (or inclusion), of Schapelle herself as a suspect. So (as Isogon was a joint operation between the AFP and the Queensland Police), even if the AFP carried out no direct investigations into Schapelle, which is highly unlikely, they would have liaised with the Queensland Police on this matter. So can you please ascertain . . .

a) Whether or not there was ever a forensic investigation of Schapelle's home premises (and relevant vehicles), for drug residues and drug paraphernalia - and if not, why not?

b) Whether or not there was ever an investigation into her phone and banking records. If so, what was the result? And if not, why?

c) Whether or the AFP (or the Queensland Police), ever interviewed senior criminologist Professor Paul Wilson re his findings on Schapelle?

I'm currently going through The Whitewash Report section by section, so you'll be hearing quite a bit from me over the next few days - but let's take this one item at a time.

I note this quote at point 2.2.1.1.

The Hidden World Research Group has obtained correspondence from a leading forensics expert, who offered to perform these precise tests at the time. The AFP did not pursue this, and refused to facilitate the testing of the marijuana placed in Schapelle Corby‟s bag, when approached. Note also that such tests were well established at that time.

So can you please do these further investigations, if it's not too much trouble. I note it may involve something more than simply exchanging jovial and over-familiar emails with the organisation you're supposed to be investigating (which, it's not unreasonable to assume, has something to do with your spectacular lack of success) - but I believe considering the extremely high price some have already paid for your sleepwalking . . .

As per this 7 December 2004 letter from DFAT to AFP Officer Michael Phelan about Schapelle (and forensic testing of the physical evidence in her case), also reproduced at EXPENDABLE.TV, can you please provide me with documentary evidence relating to his efforts to . . .

1. Request and investigate the identities of all the airport staff who checked Schapelle's luggage in, and handled it up until the point it was loaded on to her international flight.

2. Request and investigate all the CCTV footage of the relevant staff, at the relevant times.

3. Gather the fingerprints of all the relevant staff, and possibly crossmatch them with known offenders.

4. Investigate the possible forensic histories of all the relevant staff.

5. Contact forensic botanists with relevant and appropriate experience, such as Dr. Lynne Milne.

Re: A Formal Freedom of Information Request to DFAT.

As graphically shown here, Indonesian authorities repeatedly handled the physical evidence (in Schapelle's case), in a grossly illegal and unprofessional manner - and then went on to burn it without any form of physical investigation, blatantly ignoring the repeated requests of both Schapelle and her lawyers for forensic examination.

This obviously contravenes DFAT's guidelines on the conduct of overseas trials, Point 6.14, bullet 3 - and as it also contravenes article 72 of the Indonesian Legal Code, it's further in breach of DFAT's guidelines on the treatment of Australians detained overseas, Point 6.1 - bullets 2 & 3.

I also note there is more much detailed discussion of these matters at EXPENDABLE.TV, as well as HERE.

And if I may digress for a moment (just for your general information), may I draw your attention this FOI request to the Prime Minister's Office, of 5 Jan 2012 (which has still not received an acknowledgment), also seeking to clarify how well the Australian Government seeks to protect the rights of its citizens prosecuted and jailed overseas - as I assume (as would most others), that gross sentence discrimination is in breach of Point 6.1 - bullet 3 too.

So can I please have . . .

1. All correspondence from DFAT to either/or:

a) Any section of the Australian Government (political or administrative).

b) The Australian Federal Police.

. . . specifically mentioning (or requesting), the use of the Australian Mutual Assistance in Criminal Matters Act , specifically Article 12 (in relation to the physical evidence in Schapelle's trial). As it's alleged the marijuana was cultivated and supplied in Australia, the physical evidence was highly pertinent to crimes committed here, e.g. supply and cultivation. Plus of course, this event was an absolute first, as confirmed by both Australian Customs and contemporary press reports. Wasn't anyone in the entire Australian Government interested in discovering who would be idiotic enough to cultivate and supply marijuana, then send it FROM Australia, TO Indonesia, given the economics? Did anyone involved in this entire debacle have more than two brain cells to rub together? Let's find out.

Further to my FOI reminder to you yesterday, I note there were a whole swathe of acknowledgements (re my various requests), in my post box by the afternoon (my mail doesn't normally arrive until after lunch), including the one I wrote to you about. Thank you.

As graphically explained in this blog post, there were a whole range of serious and glaring anomalies on the morning Schapelle flew that should have alerted any minimally competent police force re the need to expertly gather and preserve all the relevant evidence. However, I note that on the day in question, the Australian Federal Police failed to preserve a single frame of CCTV from any of the hundreds of cameras (within three Australian airports), relating to either her or her luggage.

However, the UK Home Office has produced a manual, explaining the correct procedures to follow. Maybe that's why criminal British baggage handlers (who use innocent passengers as unwitting drug mules), get locked away for nearly 20 years, while ours do not?

Therefore, I'm very much looking forward to your reply to this FOI request of mine, re the CCTV footage on the morning Schapelle flew - and I'd now like to add another request.

Can you please supply me with the official operating manual (and/or formal guidelines), that the Australian Federal Police are bound by when it comes to preserving forensic CCTV evidence.

I assume that information would be similar to the UK manual, and not "Secret," given that British Home Office have already chosen to publish their relevant information - unless (of course), the Australian public aren't allowed to judge whether or not their public servants have adhered to the relevant standards? Or even if there are any relevant standards?

I note you were Australia's Attorney General between 2003 - 2007, with core responsibility for national security matters.

Thank you for the personal email you sent me to-day, after I sent you the link to this blog post of mine (about yourself), also mentioning in my message you might have incipient Alzheimers, for "Forgetting" that none of the criminal Qantas baggage handlers who helped to import around 200 kilos of cocaine into Australia in 2004, using innocent passengers unwitting drug mules, were ever arrested or charged (let alone jailed). Lucky it wasn't 200 kilos of Semtex, eh? Perhaps you should travel to the UK for some in-service education? The UK security services tend to treat criminal baggage handlers who endanger the flying public rather differently. In that country, they get nearly 20 years in the slammer, not a Get out of jail free card plus around $1.6 million in public funds and an all-expenses paid "Holiday" to Switzerland - issues I'm currently investigating, as per FOI requests here and here.

I also note (for the public record), that some core factors in the Lockerbie disaster were unscreened luggage and criminal airport staff, as graphically described in this recent blog post, so here's a few other things you "Forgot" . . .

1. You "Forgot" to launch an inquiry into Schapelle's illegally unscreened bag, or inform her legal team for that matter.

2. You "Forgot" to launch an inquiry into the criminal baggage handlers on the QANTAS pay roll at the time - such as Tom, Norman Niass and Easton Barrington James, not to mention their seriously dodgy security manager.

3. You "Forgot" to launch an investigation into the serious allegations of Australian Protective Services Officer Gary Lee Rogers (re massive breaches of aviation security), even though he complained directly to your department.

4. You "Forgot" to launch an inquiry into the serious and dangerous findings of Customs Officer Caterina Magni, until this information was leaked to the press and you were forced to act. Though the customs officer your Government viciously persecuted as a result of this leak says things are just as bad now.

I think that just about sums it up for now, except for one other thing - I'll send you (and the rest of the World), a copy of the scorching new documentary about your core failures (and those of your cronies), when it's released, very, very soon . . . I hope you enjoy it.

Schapelle Corby - The Australian Federal Police Are Ignoring A Crucial FOI Request Re Criminal Baggage Handlers

Good morning,

As of Monday 16th January 2012, I note you have failed to acknowledge my Freedom of Information request of 29th January 2011, relating to the criminal baggage handlers (at Sydney International Airport), that you identified in your November 2009 Submission to the Australian Senate.

Can I also remind you that then Attorney General Phillip Ruddock also unequivocally identified their criminal behaviour on page 128 of the official Hansard, No. 5, 2007.

It is also somewhat surprising that those with the authority to do so chose to pursue and prosecute relatively minor players like Gilbert Gideon and David Darley Dowe, who were not baggage handlers (in relation to this cocaine importation), plus use some of the most disgusting, dangerous and outrageous methods ever to catch them - while letting a major criminals like Qantas baggage handler Tom go free (as well as rewarding him with nearly $1.6 million of public money), plus allowing the baggage handlers who imported 200 kilos of this cocaine into the country to go free. I note Gedeon and Darley Dowe were sentenced to 10 and 12 years respectively, for buying three kilos and one kilo of cocaine (respectively) - which is a great deal less than aiding in the importation of 200 kilos, isn't it? Though maybe they didn't have Tom's skills in setting up Swiss bank accounts for very senior corrupt police officers?

Quite honestly, your organisation is a joke - an outfit that routinely sets major criminal sharks free, while proudly (and quite bizarrely), parading the minnows. And not only that, you actually use the sharks to catch the minnows - so here's Earth calling the Australian Federal Police, make a note to self, it's supposed to be the other way around . . .

So please take this as a formal reminder re my 29 December 2011 FOI request (as described above), and I trust I'll hear from you soon on this matter.

In August 1999, he had written a detailed and extensive report which alleged "significant faults" in the APS and the "obvious security risks at Sydney Airport and other sensitive establishments which highlighted a weakness and extreme laxness in the security of these facilities".

2. Plus any and all reports Gary Lee Rogers made to his superiors in relation to corruption, wrong doing and maladministration:

"I took documentary evidence of this and other improprieties within the APS to the then deputy director of the APS."

3. Details of any and all further action that was taken as a result of Gary's 1999 report, plus any and all further action that was taken as a result of his complaints:

"I was told that a full investigation would be conducted and I was to keep all of this confidential so as not to prejudice the inquiry.

And may I take this opportunity to remind you (and the rest of the public), what happened to Gary Lee Rogers when he complained of these horrific security breaches at Australian airports, as well as what happened to Allan Kessing - plus the continuing failure of the Office of Aviation Security to respond on the terrible security breaches that condemned an innocent tourist.

Over 4 months ago, on 5 September 2011, I wrote to Brendan O'Connor, asking him if there was ever a formal inquiry into the horrific disappearance of police weapons (and other inventory items), as documented here, and as reported by Australian Protective Services Officer Gary Lee Rogers. Not long after Gary's report, he died of "Natural causes" in the presence of a bloody knife. I also wrote to (and phoned), Brendan again 2 months later about this - but my important question has met with a complete wall of silence, Brendan didn't even acknowledge it.

So Nicola, was there ever an inquiry? And how many times do I have to publicly write to you (and phone you), before I get a reply?

You may also recall the note sent to Schapelle's legal team about this matter in 2005.

Further, I wish to inform you that your Department have acted illegally, in completely ignoring my Freedom of Information request (re this matter), for over 2 months. If I don't have a response by close of business on Monday 23rd January 2012, I will take this issue to the Information Commissioner.

Briefly, the Australian Federal Police admitted they have NO documents related to an inquiry into the inventory losses reported by Gary Lee Rogers, and Jackie Matan of their FOI Department suggested (when I asked her), that the Commonwealth Attorney General's Department may hold them (if they exist). That's why I put in the above mentioned FOI request on 4 November 2011.

Or can we assume that Brendan O'Connor failed to respond to my question, and your Department failed to respond to my FOI request, because there never was an inquiry into the terrible losses Gary reported?

Please get back to me on these matters ASAP.

But digressing for just a moment, I also note (as per that last linked article), that "Tom" the QANTAS baggage handler (and cannabis trafficking abuser of the flying public), was also an expert in setting up Swiss bank accounts to launder drug money . . . (I wonder if this unique skill was a key selection criteria for his employment?) . . . Quote:

"Not only was he involved in the importation and subsequent sale of $30 million worth of cocaine, he also set up Swiss bank accounts for syndicate members to launder millions of dollars worth of drug proceeds."

So I'm (also), very much looking forward to a response to this FOI request, in relation to "Tom's" Government-sponsored trip to Switzerland.

So can I please have:

1. A copy of the above mentioned "Memorandum of Understanding," which (I assume), would also explain (to the community at large), how a violent criminal who did not fully disclose his offences was given the hugely expensive privilege of witness protection, as also discussed here.

2. All formal investigations and correspondence relating to Tom appearing on national television in 2011, and claiming he committed perjury in 2006 . . . as per this quote . . .

"Further, I believe "Tom" should be charged with perjury - because he either lied to the court in March 2006, or he lied to Channel 10 in 2011 (frame 0.57 to 1.28). Which was it?"

Because I (and most other reasonable people), would assume appearing on national television, and admitting to a criminal act, contravenes the conditions of his inclusion in the programme? At least, that's what it says here (Section 9 - points 2 a (i) and 2 b).

I also believe that due to the stench surrounding this transaction, it's very much in the public interest for this information to be released, especially given this man's violent history and potential to re-offend - and it can be done in a way that does not compromise "Tom's" present whereabouts and identity. Though when "Tom" voluntarily appears on national television, one has to wonder why other people are "Protecting" him at great public expense, when the "Gentleman" himself is so blatantly cavalier.

Good morning,

I note Peter Hamill QC is representing Gilbert Gideon in 2012.

May I suggest to you both that the bizarre and ongoing reluctance of the establishment to acknowledge the glaring corruption in this case is very closely related the high profile jailing of Schapelle Corby, and the huge consequences of exposure.

Gilbert Gedeon was convicted on the evidence of a Sydney International Airport/QANTAS baggage handler (Tom), who was involved in using other innocent passengers as unwitting drug mules during the exact hours she flew. In fact, I believe the cocaine Gedeon is accused of buying was smuggled into the country on the very day in question. But quite bizarrely, despite the pursuit of Gedeon, those baggage handlers engaged in much more serious crime (given the horrific implications), were never arrested or charged.

Further, I believe "Tom" should be charged with perjury - because he either lied to the court in March 2006, or he lied to Channel 10 in 2011 (frame 0.57 to 1.28). Which was it? Further, I believe his inclusion in the Witness Protection Programme breached many core points of the act, given that he failed to fully disclose his criminal history before he was granted immunity - and given the seriously violent nature of his offences (as discussed in this recent article).

So how the hell does "Tom" earn his living now? Does he have a licence to kill? What protection does the community have from his further criminal acts? What continuing supervision is he under? These are all very serious questions.

I would also draw you attention to these multiple, relevant FOI requests (with more in the pipeline), and the coming documentary via EXPENDABLE.TV (due for release very soon). I will keep you updated as they progress.

3. All emails between "Tom" and Mark Standen.

4. Every scrap of information and documentation relating to this money, hi-lited in blue bold:

"As well as $200,000 for sustenance '$44,186.90 was spent jointly by the commission, the AFP and NSW Police on operational expenses relating to Tom', according to the commission." Article here

Re: Request for transcripts of the relevant AFP witness interviews

As explained at EXPENDABLE.TV with The Transit Report, if Schapelle's boogie board bag had contained 4.2 kilos of marijuana on check-in, it would have sparked a manual examination of the item. Further, senior airport sources told Courier Mail journalist Darryl Passmore the chances of such a large amount of stinking contraband getting past the many airport security checks were essentially "Zero."

It's also normal to assume that any professional policeman (who wasn't the recipient of bribes to look the other way, or terminally stupid), would have been highly suspicious of corrupt insider activity because . . .

1. A deliberate flow of marijuana FROM Australia, TO Bali does not exist - and never has (as confirmed by Australian Customs), for very obvious economic reasons (also underlined in numerous contemporary press reports).

2. Schapelle had no criminal history or criminal profile.

3. There was a long history of corrupt insider activity at Australian airports, including the use of another innocent passenger as an unwitting drug mule by the same baggage handlers who "Dealt" with Schapelle's bag.

4. There was direct evidence of corrupt interference with Schapelle's bag after check-in.

Therefore, I assume the AFP would have formally interviewed all the airport staff who dealt with her bag at and after check-in (as shown here, in this diagram within this report), to ascertain . . .

a) If any anomalies with her bag were noticed on check-in, or at any time afterwards - plus what actions were (or were not), taken in regard to that bag.

b) How and why her bag escaped the normal screening process.

Schapelle Corby - Horrific Airline Security Breach: A Formal Freedom of Information Application to The Australian Federal Police

This is a formal application for information. Please treat it as such.

As published within The Transit Report at Expendable TV, on 11 July 2005 former Chief of the Australian Federal Police Mick Keelty sent this letter to Michael Taylor at the Dept of Transport & Regional Services, asking him why Schapelle's boogie board bag was not screened before it was loaded on to an international flight to a high risk destination (given the circumstances of the Bali bombings). Mr. Taylor's reply made it quite clear this lack of screening was very irregular, as well as criminal - because, as explained within Australia's Aviation Transport Security Act of 2004 at Regulation 2.18 (on page 15) . . .

Certain airports are required by regulation 4.29 to have specified domestic checked baggage screening (CBS) capability.

Only screened and cleared checked baggage may be loaded onto an aircraft operating international air screened services (see regulation 4.24).

. . . further emphasised at Regulation 4.24 (on page 58) . . .

This regulation obliges the operator of an international screened air service to only load checked baggage that has received clearance. Contravention is an offence of strict liability attracting a maximum penalty of 50 penalty units.

I also note that in regard to the Lockerbie disaster of 1988, lack of screening was identified as a key factor in that terrible tragedy . . .

"The unaccompanied bag was placed on Pan Am 103A, a feeder flight, and was transferred to Flight 103 at Heathrow Airport, outside London. We also established the bags transferred from Pan Am 103A were taken directly from that aircraft to Pan Am 103, and that they were not counted or weighed. Moreover, they were not reconciled with the passenger manifest, and they were not x-rayed at Heathrow."

. . . as well as the criminal background of key airport staff . . .

"We also discovered the man in charge of the ALERT operation in Frankfurt and responsible for the security of Pan Am flights had a criminal record. His hiring practices had more to do with his personal orientation than with any other relevant factor."

And that second quote reminds (very much), of the QANTAS/Alan Conwell security manager debacle, considering the criminals employed by the airline on his "Watch."

So in the light of the above facts, can the Australian Federal Police please supply with all documentation relating to their further investigations into . . .

1. The horrific aviation security breach identified by Michael Taylor, in his direct reply to AFP Chief Mick Keelty.

2. The employment of QANTAS security manager Alan Conwell.

3. The employment of Tom, Norman Niass and Easton Barrington James (considering they were all QANTAS baggage handlers with serious criminal histories at the time in question).

4. Mick Keelty's decision not to inform Schapelle's legal team (at any time), about the illegal treatment of her luggage, once she entrusted it to QANTAS. And in asking this last question, I must admit, I'm very much reminded of this satirical skit from ABC Australia's comedy programme The Chaser.

Re these quotes:

Leaked documents obtained by The Weekend Australian indicate that as recently as 2006, AFP agents failed to act on allegations by drug bosses, in formal interviews, about Mr Standen.

Leaked documents also indicate that in 2006, AFP agents failed to act on allegations by the late cocaine kingpin Michael Hurley -- who was then facing drugs charges -- about Mr Standen. In March 2006, Hurley alleged during a formal interview with the AFP that the officer -- now awaiting trial on drug charges -- was fabricating evidence against him.

It was not until 14 months later -- according to an AFP statement issued this year -- that the officer was identified by the AFP as a "person of interest" following a tip-off from overseas police on a drug importation plot into Australia.

Hurley, 61, died last year of cancer while awaiting trial for masterminding cocaine smuggling involving baggage handlers at Sydney airport. He made the allegations during an interview with AFP officers attempting to discover who tipped him off in 2005 that he was a target of a joint AFP-NSW Crime Commission investigation.

Can you please supply me with:

The transcripts (and video footage), of all Australian Federal Police interviews with criminals (including Michael Hurley), that mention Mark Standen.

On the 1st of November 2007, the Australian newspaper reported that your organisation had received serious allegations against both the ACC and the AFP, in relation to drug trafficking and supply.

Can you you please provide me with:

1. All the documentation your organisation holds in relation to those allegations.

2. Evidence of your interviews with Ray Cooper and Bruce Griffin, as I requested from your organisation in September 2010 . . .

Bruce Griffin (paragraph 21), a former NSW drug squad detective, testified that some local drug traffickers (with the help of airport contacts), use the luggage of innocent passengers to move drug shipments between Australian cities - an accusation also echoed by Ray Cooper, former Chief of Internal Investigations for the Australian Federal Police. Please make sure you talk to both former officers, and retain transcripts of these interviews.

3. All documentation relating to your decision NOT to interview Ray Cooper and Bruce Griffin, if you failed to carry through on that very obvious step.

I am sure you have heard of the Lindy Chamberlain case, and the bizarre fabrications printed by the Australian media to demonstrate her "Guilt." This was very recently discussed at length by The Guardian newspaper UK - also the employer of journalist Nick Davies, and I'm sure you are aware of his achievements, vis a vis media wrong-doing.

I am writing to you now because the Australian print media is now engaged in another vicious witch hunt, in regard to Australian Schapelle Corby. Lindy Chamberlain's ex-husband Michael Chamberlain recently said the lies were part of a campaign to protect the Northern Territory tourist industry, as baby-eating dingoes aren't good for business. In a similar vein, I guess drug smuggling Qantas baggage handlers aren't good for our national airline - and an innocent Australian incarcerated in an Indonesian hell-hole isn't good for massive Australian investments in that country.

Recently, there was wide spread reporting of claims that Schapelle's Father supplied the drugs found in her bag, in Bali. This reporting was patently absurd, for reasons not a single news outlet in Australia chose to disclose . . .

1. Australian Customs confirm there is NO commercial flow of marijuana FROM Australia, TO Bali, and there never has been.

2. Early press reports confirm there is NO commercial flow of marijuana FROM Australia, TO Bali, and there never has been.

3. Official data from the United Nations Office on Drugs and Crime exposes the gross lies of the principal informant, including the economic impossibility of smuggling marijuana FROM Australia, TO Bali.

4. Both the South Australian Police and the Queensland Police have formally denied the claims of the principal informant.

5. Schapelle's father had a clean background.

However, when I formally complained about this gross lack of balance to the Australian Press Council, my concerns were dismissed out of hand.

I am also concerned that the Australian print media is now consistently refusing to report major (and very serious), facets of Schapelle's case, as just detailed in my multiple Freedom of Information applications (scroll down to " . . . and here's confronting the lies of omission").

I very much look forward to your considered response to this extremely serious issue - or are we to assume that in over thirty years, nothing has changed?

On the 8th of October 2004, Qantas Airlines illegally carried unscreened luggage, and on 13 December 2011, I put in a Freedom of Information application to Australia's Office of Transport Security, relating to that horrific breach. I also note we have just passed the 23rd anniversary of the Lockerbie disaster, and I watched this National Geographic programme about it yesterday evening.

However, in their infinite wisdom, that department has decided the information I'm seeking "Is not in the public interest," and has thus decided to impose a fee of over $1,200 on an ordinary member of the public (me), who is trying to access it. Here is their email to me, and here is their letter. I am appealing that decision with you, on the grounds that information is manifestly "In the public interest" - and I very much think the families of the 270 victims of the Lockerbie disaster (and every other reasonable person reading this), would agree with me.

In November 2011 I made this FOI request to the Australian Federal Police (investigating whether or not an illicit flow of marijuana FROM Australia TO Indonesia has ever existed), and I've just received this point blank refusal from them, so I'm formally writing to you now to appeal that decision.

At no time (that I am aware of), did their FOI officer phone me to discuss this fairly straightforward matter. Briefly, I am seeking public information relating to the commercial, criminal smuggling of marijuana FROM Australia, TO Indonesia (if such an illicit flow exists, and the press quotes above seem to indicate it doesn't) - such as data relating to arrests for this crime, staff training materials relating to detecting this crime, and formal inquiries/investigations into this crime.

Now this shouldn't be be too difficult, as I believe this is exactly the kind of information routinely collated and collected by the United Nations Office on Drugs and Crime.

Further, if no such data exists (which it may not, because smuggling marijuana FROM Australia, TO Indonesia is not an economic proposition, and never has been), then I expect the AFP to tell me that in writing - and not wilfully avoid that obvious point by saying, in the 21st century, it's "Too difficult" for them to access information (re international trends in drug crime), which is routinely collated and collected by the United Nations.

Or maybe, considering the circumstances, it's just too embarrassing for them to put that obvious point in writing?

As this correspondence makes perfectly clear, Schapelle's boogie board bag was (quite illegally), loaded on to her flight to Indonesia without any screening. The security implications of this are horrific. Can you please supply me with any and all investigations (and recommendations), your department carried out in relation to that specific breach - and also any correspondence relating to the decision not to provide information about that specific breach to Schapelle's lawyers at the time of her trial.

Considering the latest news about Fred Martens, I most certainly think it is - for these very good reasons . . .

Hiding primary evidence, e.g. the fact Schapelle’s boogie board bag was not entered into Sydney Airport Corporation’s computerised luggage handling systems, and was (quite illegally), not screened before it was loaded on to her flight to Indonesia.

Failing to investigate and report on that horrendous security breach, despite the terrible potential outcomes of not doing so.

Failing to act on Caterina Magni’s damning report into Australian Airport security in a timely manner, and only doing so after high level publicity.

Failing to use the Mutual Assistance in Criminal Matters Treaty (with Indonesia), when it was appropriate and vital to do so.

Failing to preserve a shred of pertinent CCTV imagery within Australia.

Failing to explain why Qantas/Sydney Airport baggage handlers, who the AFP openly admit were engaged in major criminal acitivity (on the day Schapelle flew), were never arrested or charged.

Failing to launch any police investigation into the Australian source of the drugs found in Schapelle’s bag.

Failing to investigate the allegedly corrupt police named by police informant “Tom.”

Failing to explain the source of the $750,000 (or so), the Director of Public Prosecutions allowed a $20 an hour (or so), Qantas baggage handler (“Tom”), to keep, post him making those serious allegations - who was also the man who took this this photo.

Employing baggage handlers at Sydney International airport with serious and extensive criminal histories - such as “Tom,” Norman Niass and Easton Barrington James.

Failing to formally and officially object (to Indonesia), re:

The unprecedented severity of Schapelle’s sentence.
Their failure to weigh Schapelle’s luggage on arrival.
Their failure to preserve a single shred of CCTV, relating to her arrest and interrogation.
Their failure to treat the physical evidence in an appropriate manner, and their failure to arrange appropriate forensic testing.
Their failure to provide any evidence that Schapelle was “Trafficking” marijuana, despite the fact she was convicted of “Trafficking” in the most bizarre circumstances, as a flow of this drug FROM Australia, TO Indonesia does not exist, and never has - for very obvious economic reasons.

Since becoming involved in this injustice, there's one thing that's never ceased to amaze and puzzle me, why are some people fighting so hard to keep Schapelle where she is, given the continuing smears? What's the big deal?

She's just an ordinary young woman, who could have been any one of us, or anyone of our loved ones, who was swept up in a horror beyond her comprehension. Many people see and understand the terrible corruption that led up to that - but I'm really not interested in it, other than using exposure (if necessary), as a lever to get her home.

Once her feet are back on Australian soil, I will (with very great pleasure), delete this whole blog, never ask another question, and never send another email. My garden is crying out for attention. I also think many other campaigners feel the same. It's amazing what can happen when you just ask nicely.

What's done is done, it cannot be undone - there's no place for hate, no place for recriminations, no place for blame. That's destructive. This is about going forward into the light, into healing and compassion.

And lets' face it, who is to judge? None of us are perfect, and I think the root of all evil is fear. Sometimes people are unkind, callous, greedy, arrogant, corrupt or whatever - but that's their path to learn from. And hopefully, when it's time for them to look into the dark face of mortality and decay (as we all do), that anxious pain will disappear, and they'll realise they're held in the deeply loving heart of the Universe.

So what's the point of wealth, if you have the heart of a frightened pauper - and if a poor man has a soul bursting with joy, love and laughter, tell me, who is the richer? What's life worth, if truth is your enemy? I once found a wallet in the shopping centre car pack, bursting with cash. I never counted it, but it was probably a couple of thousand dollars. If I'd just put it in my pocket, kept the money and walked away, no-one would have known - but I'd have known. And that's the point, I couldn't do it because I knew how I'd feel if it was me. There was a drivers licence in there too, so I found the guy, and took his cash back to him. He was amazed, and very grateful. And I just felt so good, much richer than $2,000 (or so), would have made me.

This is the glue that has enabled our evolution and survival for millions of years - empathy, co-operation and love. It's hard wired into our genes. There's a much deeper past than wars and conflicts, one that was almost edited out of history - and it's the tale of our mutual and joyful inter-dependence.

So anyone who can see what Schapelle is going through, and look the other way, hide the truth and even try to harm her, is living in absolute poverty - whatever their bank balance says

I've been reading Starhawk's books since the early 80's - and these lines she wrote once have always stuck with me . . .

Where there's fear there is power 
Passion is the healer 
Desire cracks open the gate

So it's noticeable that although Duffer spent considerable energy (in his book), attempting to trash Schapelle's various supporters, the one name he didn't dare mention, even to damn it, was EXPENDABLE.  I think that's a very big lesson for us . . .
